UP and UPC Territory


While the Unitary Patent System is open to accession by any EU Member State (but not other EPC Member States), not all EU Member States participate to the Unitary Patent or have signed the UPC Agreement. This map helps to understand what is the situation of each EPC Member State with respect to the Unitary Patent System. Important: In accordance with Article 18(2) of Regulation (EU) 1257/2012, a Unitary Patent shall have unitary effect only in those participating Member States in which the Unified Patent Court has exclusive jurisdiction with regard to European patents with unitary effect at the time of grant.

For the time being, Poland has not accepted the jurisdiction of the UPC and Unitary Patents will therefore not have effect in Poland unless Poland decides to sign and ratify the UPC Agreement.

Announced Local and Regional Divisions


Local divisions can be set up on request of a Contracting Member State, with the possibility to set up one additional local division for every one hundred patent cases commenced in the Contracting Member State per calendar year (up to a maximum of four local divisions in a Contracting Member State). Regional division can be set up on request of two or more Contracting Member States. This map displays the local and regional divisions that have been announced to date.
